GALE Pacific is committed to protecting customers from counterfeit, diverted, or improperly handled products. We maintain an Authorized Reseller Program to ensure customers always receive authentic GALE Pacific products backed by our warranties and support.
GALE Pacific Limited (“GALE”) is a leading global manufacturer and marketer of branded technical fabrics and shading products for domestic, commercial, and industrial applications. GALE Pacific pioneered high-density polyethylene (HDPE) shade fabrics in the 1970s and today produces advanced polymer fabrics including knitted and woven HDPE and polypropylene (PP), coated HDPE and PP fabrics, and PP coated mesh fabrics. Our consumer products are marketed worldwide under the Coolaroo® brand.
GALE Pacific values a retail distribution network that stocks, promotes, and supports its products. To ensure consumers receive a consistent, high-quality experience, GALE Pacific products are sold only through authorized brick-and-mortar and online channels. This Authorized Reseller Policy (the “Policy”) sets out requirements for the resale of GALE Pacific products (“Products”) to maintain the integrity of our distribution network.
By purchasing GALE Pacific Products for resale, each reseller (“Reseller”) agrees to comply with this Policy. Resellers who fail to comply will be considered unauthorized and will have no right to:
Applicability
This Policy applies to all GALE Pacific products marketed under the Coolaroo®, GALE Commercial™, or GALE Pacific® brands, regardless of how or from whom the Products were acquired, whether directly from GALE Pacific, through an authorized distributor, or by other means.
“Resellers” include:
No other reseller is authorized to sell GALE Pacific Products.
Sales to End Users Only
Resellers may purchase Products solely for resale to end-user customers. Resellers may not sell Products to other resellers, distributors, or for further distribution without written approval from GALE Pacific.
No Sales on Marketplaces
Resellers may not sell Products directly or indirectly through third-party retail websites, auction sites, or affiliated marketing websites, such as Amazon, eBay, Walmart, Rakuten, and similar platforms, unless expressly permitted in writing by GALE Pacific under an approved marketplace partnership.
Intellectual Property
All GALE Pacific intellectual property, including brands, logos, trademarks, trade dress, service marks, and copyrighted materials, is the exclusive property of GALE Pacific. Authorized Resellers may use GALE Pacific trademarks, images, and product information solely to resell Products. Resellers have no proprietary rights in GALE Pacific intellectual property.
Use of GALE Pacific Intellectual Property
GALE Pacific strictly prohibits any person or entity from using its brand names, trademarks, logos, copyrighted materials, or other intellectual property without express written permission. This includes, but is not limited to, use on websites, social media, product listings, marketing materials, or packaging that could mislead consumers into believing the user is affiliated with or authorized by GALE Pacific.
Unauthorized use of GALE Pacific’s intellectual property will result in immediate enforcement, which may include cease-and-desist communications, takedown requests, and pursuit of legal remedies for trademark infringement.
Unauthorized Sellers
Resellers found to be unauthorized violate this Policy. GALE Pacific reserves the right to take enforcement action against unauthorized sales. Products purchased from unauthorized resellers are not covered by GALE Pacific’s consumer warranty or customer support.
Policy Violations
Violations of this policy may result in immediate revocation of Authorized Reseller status. GALE Pacific reserves the right to take enforcement action against any unauthorized resale or misuse of its intellectual property, which may include cease-and-desist notices, takedown requests, or other legal remedies. Upon revocation, Resellers must immediately cease the sale of GALE Pacific products.
